Background:
In early February 2020, OECD/G20 released a report on Transfer Pricing Guidance on Financial
Transactions. The report is substantial because for the first time the OECD Transfer Pricing
Guidelines include guidance on transfer pricing aspects of financial transactions (treasury functions,
intra-group loans, captive insurance, and others). The implications of the guidance in turn needs to
be reviewed. In particular, regarding ways to implement the arm's length principle and how it can
help avoid transfer pricing dispute.
